Other Details None specified INCORPORATION. The terms and conditions of the current Rules of the Association are incorporated in their entirety into this contract of insurance. IMPORTANT INFORMATION MATERIAL FACTS. You have a duty to disclose all Material Facts to us. This is a continuing obligation that applies both before and during the period that you are insured with us. Material Facts are those facts, matters or circumstances that may influence whether or not we wish to insure you and upon what terms. If you have any doubt whether or not a fact, matter or circumstance is material it should be disclosed. Your failure to disclose such facts may result in our refusal to pay your claim. AREA OF NAVIGATION AND OPERATIONAL DETAILS With respect to all risks: Malaysia Near Coastal Protective Co-Assurance It is agreed that the parties named above, who have either entered into a charterparty or contract for the provision of services by the ship, or who are associated or affiliated to that company, or who are contractors, sub-contractors or clients of any tier of that company, are co-insured under this Certificate of Entry. The named parties can only recover from the Association those liabilities, costs and expenses which are: the liability of the Member under the terms of the charterparty or contract; and which would have been recoverable from the Association by the Member had such claim been made and enforced against him. If the terms of the charterparty or contract are not ‘knock for knock’, i.e. they do not provide that the Member and the charterer/contractor are each responsible for any loss or damage to their own property, or property of their contractors, sub- contractors or clients of any tier, or for loss of life or personal injury to their employees or the employees of their contractors, sub-contractors or clients of any tier, then the cover provided to co-insured is limited to that set out in the Member’s contractual liability clause. Once the Association has indemnified a co-insured it shall not be under any further liability and shall not make any further payment to any person or company whatsoever, including the Member, in respect of that claim. It is further agreed that rights of subrogation against the named co-insured in respect of any liability which is the responsibility of the Member under the charterparty or contract are waived.
